DTN Addendum – Ag Weather Station

This addendum to the Subscription Agreement (“Agreement”) is made and entered as of the date DTN accepts Customer’s order and contains supplemental terms and conditions for the DTN Ag Weather Station, which may hereinafter be referred to as “Ag Weather Station”, and also may consist of one of the following leased Equipment options:

Customer hereby accepts these additional terms and conditions when purchasing Ag Weather Station:

If applicable, Customer is fully responsible for setting-up and paying for its own power and internet connections associated with the Ag Weather Station, which may be restricted to certain providers. Unless Customer elects the Cellular Option noted above, DTN shall not be held liable for any telecommunication, connection, or carrier fees associated with such leased Equipment.
Customer will promptly notify DTN in the event the Ag Weather Station has any functional issues or has been damaged.
DTN will make its best effort to service the Ag Weather Station at least once per calendar year as long as Customer is a subscriber of DTN Services. Notwithstanding the foregoing, from time to time Customer may be required by DTN to clean or make minor adjustments to the Ag Weather Station. In such event, Customer will reasonably follow the instructions provided by DTN’s customer support department.
Customer will be charged a one-time flat fee of up to three hundred and fifty United States Dollars ($350.00 USD), which includes on-site technical assistance, return shipping, and handling charges, for each occurrence in which the Ag Weather Station is damaged or broken outside of a manufacturing defect, including but not limited to accidental damage, or any damage due to acts of God such as lightning strikes. DTN will not charge Customer a fee for any repairs due to manufacturing defects. Notwithstanding the foregoing, any such accidental damage will be reasonably determined in DTN’s sole discretion. In the event the Ag Weather Station is damaged, Customer will contact DTN’s customer support team at:

Customer understands that the Ag Weather Station and accessories are provided as leased Equipment in accordance with the terms and conditions of the Agreement, and that a portion of the bundled Service fee may include a rental fee as determined and updated by DTN throughout the duration of the Agreement. DTN shall retain full ownership and security interest in the leased Equipment (including any accessories). When Customer’s Service ends under the Agreement, Customer will promptly return such leased Equipment in good operating condition and proper packaging, ordinary wear and tear excepted, to the following address (which may be updated by DTN by providing written notice to Customer):

La Vista, NE 68128In the event the aforementioned leased Equipment is lost, stolen, or not fully returned to DTN, Customer will be charged a one-time amount of eight hundred United States Dollars ($800.00 USD), or the then-current market value, whichever amount is greater and determined in DTN’s sole discretion and in accordance with the standard terms and conditions within the Agreement.
Customer acknowledges and understands that it must maintain a subscription to certain DTN Services in order for DTN to receive and display any data or information from the Ag Weather Station. In addition, Customer acknowledges and understands that DTN shall have and maintain full ownership rights in and to any data or information generated from the Ag Weather Station. DTN hereby grants to Customer a non-exclusive, non-transferable, limited license to use any data or information created or derived in connection with Ag Weather Station for its internal purposes only and for the duration of the Agreement.
This addendum modifies and supplements the Agreement solely to the extent expressly set forth herein. All other terms and conditions within the Agreement, including any amendments or addenda thereto, remain unchanged and in full force any effect.
